・・・We,the Japanese people,acting throuth our duly elected representatives in the National Diet,determined that we shall secure for ourselves and our posterity the fruits of peaceful cooperation with all nations and the blessings of liberty throughout this land,and resolved that never again shall we be visited with the horrors of war through the action of government,do proclaim that sovereign power resides with the people and do firmly establish this Constitution.Government is a sacred trust of the people,the authority for which is derived from the people,the powers of which are exercised by the representatives of the people,and the benefits of which are enjoyed by the people.This is a universal principle of mankind upon which this Constitution is founded.We reject and revole all constitutions,laws,ordinances,and rescripts in conflict herewith. We,the Japanese people,desire peace for all time and are deeply conscious of the high ideals controlling human relationship,and we have determined to preserve our security and existence,trusting in the justice and faith of the peace-loving peoples of the world.We desire to occupy an honored place in international society striving for the preservation of peace,and the banishment of tyranny and slavery,oppression and intolerance for all time from the earth.Werecognize that all peoples of the world have the right to live in peace,free from fear and want. We believe that no nation is responsible to itself alone,but that laws of political morality are universal;and that obedience to such laws is incumbent upon all nations who would sustain their own sovereignty and justify their sovereign relationship with other nations.  . | ついでに世界の憲法のお手本というのは、１０条以降の人権条項についてですか？９条ですか？全文ですか？ 日本国憲法は、形式は明治憲法（大日本帝国憲法）そのまま。理念は人権条項はアメリカ独立宣言・合衆国憲法（要するにジョン・ロックの人権概念）を盛り込んだものです。 英語を直訳したというのは嘘です。マッカーサー草案の英語原文は所在不明ですが、外務省直訳文を今でも読むことができます。現行憲法とは表現が違います。 表現だけでなく、マッカーサー草案では一院制だったのが二院制に修正されたのを始め、議会（帝国議会）の修正事項では、１０条・１７条・４０条・６６条などの全文追加ほか、９条・１５条・２５条などの一部追加、前文・１条・２７条・４４条などの修正など、様々な修正が行われています。 「これを」が不自然に入っているのは、明治憲法にも民法民事訴訟法、刑事訴訟法、教育基本法など他の法律にも見られることで英語の「ｉｔ」の訳だというのは完全な嘘です。 👍 [No6] 2004/03/19 23:30 |

 . | 近代憲法というものを知らないのでは＞もはや独善や偽善、不合理な理想論だけで塗り固められた法ではどうしようもないでしょう。 確認したいんだけど、あなたのその基準でいうと『アメリカ独立宣言』や『アメリカ合衆国憲法』、『フランス人権宣言』、『日米安全保障条約』、『国際連合憲章』などもそうなるのだろうか。そんなに「独善偽善理想論（これも安っぽい表現だな）」と言うほど変わらないと思うが。 というより、憲法が国民から国家への命令であり、法律が国家から国民への命令だということをわかっているのか。 当然憲法というものは、国民にとって「善」なもの、「理想的」なものを書くことになるのだけれど。 👍 [No4] 2004/03/19 22:51 |
軽視しているとは思うが・・・やはり本格的な憲法改正が必要な時期に直面しているのでしょう。 九条なんかは特に。日本という国家の情勢と現況、将来的に考えてみてこれほど不合理であるものはない、と。 もはや独善や偽善、不合理な理想論だけで塗り固められた法ではどうしようもないでしょう。 👍 [No3] 2004/03/19 20:10 |  通りすがり |
